The passage of Public Law 107–118 in early 2002 provided the first legislative definition of “Brownfields,” a term coined by the real estate and regulatory communities in the early 1990s to describe environmentally impaired property with redevelopment potential, as “real property, the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminant.”
